# No car at the rental desk despite your booking: what can you claim, and who do you complain to?

> If the company cannot give you the car you booked, it has not kept its side of the contract. Which? says you can then claim back what you paid, and hire a similar car elsewhere and claim the extra cost. If you arrive late, for example after a flight delay, a company may treat you as a no-show, so tell it about the delay as early as possible and keep proof. Get the refusal in writing and keep every receipt.

You land, find the desk, show your booking, and hear that there is no car for you. Maybe the branch is overbooked, maybe it closed early, or maybe your booking was cancelled because you arrived late. ==If the company cannot give you the car you booked, you can ask for your money back and for the reasonable extra cost of getting another car.== This article explains what to do at the desk, what to keep, and where to complain afterwards.

## Why there may be no car

There are three common situations, and the one you are in decides your next step:

| Situation | What it usually means | Your position |
|---|---|---|
| Overbooking or no car of your category | The company took more bookings than it had cars | The company did not deliver what it promised |
| Desk closed or nobody there | Your arrival was outside opening hours, or the branch closed early | Depends on the opening hours in your booking |
| Booking cancelled as a no-show | You arrived later than the booked time, often after a flight delay | Depends on the no-show clause and on whether you warned the company |

If the company offers a car in a different category, that is a separate question. Read [a different car than you booked](https://scratchfair.com/en/knowledge/pick-up/different-car-than-booked-or-similar).

## What can you claim if the company has no car?

Which? explains that if an alternative car cannot be provided and you are left stranded, or you are not happy to wait for a replacement, you can treat this as the company breaking the contract. You can then claim back what you have already paid, and you are also entitled to hire an identical car elsewhere and claim back the additional costs.

The Swedish consumer agency Konsumentverket also says that you can complain if you get access to the car late, and that you may be entitled to a price reduction. In serious cases you may be able to end the agreement and get a refund for the period you could not use the car.

In practice you can ask for:

- a refund of everything you prepaid for the rental, including extras;
- the difference in price if you had to rent a similar car elsewhere at a higher price;
- reasonable costs you had because of the missing car, such as a taxi to another rental desk;
- a price reduction if you got the car hours later than agreed.

There is no fixed EU compensation scheme for car rental like there is for delayed flights. Keep your claim to costs you can show with receipts.

> [!WARNING]
> Do not just walk away. Without written proof that the desk had no car for you, the company may later say you never showed up and keep your prepayment as a no-show fee.

## What if you arrived late?

A flight delay is the most common reason a booking is treated as a no-show. ECC Malta notes in its car rental leaflet that a rental company may cancel your booking if your flight is delayed. ECC Ireland advises telling the company as soon as possible if you will be late, ideally by phone, and following up with an email so that it is also in writing.

Before you travel, check the no-show clause, the opening hours of the branch and how long the company holds a car after the booked time. If the booking form asks for your flight number, fill it in. Our [deadlines tool](https://scratchfair.com/en/tools/deadlines) helps you keep track of the dates that matter after a problem.

> [!TIP]
> Save the email you sent about the delay and a screenshot of the flight status. Together they show that you warned the company in time, which is your strongest point if the booking was cancelled anyway.

## 1. Get the refusal in writing at the desk

Ask the staff to write on your booking or on a company form that no car was available for you, with the date, time and branch. If they will not, write it down yourself with the name of the person you spoke to, and photograph the desk and any notice. A short email to the company from the desk, with the time stamp, also helps.

## 2. Contact the booking site straight away

If you booked through a broker or comparison site, call or message them at once. They may find another car through their system. Keep a record of the call and any reference number. See [who to complain to after booking through a broker](https://scratchfair.com/en/knowledge/ecc-and-disputes/booked-through-broker-who-to-complain-to).

## 3. Rent a similar car, not a better one

If you have to rent elsewhere, choose a car similar to the one you booked. The extra cost of a similar car is much easier to claim than the cost of a bigger or more luxurious one. Keep the new rental agreement and the receipt.

## 4. Keep every receipt

Collect the original booking confirmation, proof of payment, receipts for taxis or transfers and the replacement rental agreement. Add your notes from the desk. Use [Evidence Mode](https://scratchfair.com/en/evidence-mode) to store photos and documents in one place.

## 5. Complain in writing after your trip

Write to the company, and to the booking site if you used one. Explain what happened, list the costs with receipts and ask for a refund within a set period. Which? suggests giving the company a reasonable time, for example 14 days. Our [letter templates](https://scratchfair.com/en/tools/letter-templates) help you set it out clearly.

```letter
Booking number: [booking number]
I had a confirmed booking for [car category] at your branch in [location] on [date] at [time]. When I arrived at [time], I was told that no car was available. [Name of employee, if known] confirmed this. I had to rent a similar car from [other company] at a cost of [amount]. I ask you to refund the [amount] I prepaid and the extra cost of [amount], [total] in total, within 14 days. Copies of my booking, the receipts and my notes are attached.
```

## 6. Escalate if the company does not reply

If the company is in another EU country and does not help, the European Consumer Centre in your country can help for free; see [which European Consumer Centre to contact](https://scratchfair.com/en/knowledge/ecc-and-disputes/which-european-consumer-centre). If you paid by card, your bank may be able to help with a chargeback. Which? also mentions this for UK cardholders. Read more in [what to do when the rental company does not reply](https://scratchfair.com/en/knowledge/dispute/rental-company-does-not-reply).

## FAQ

**Can a rental company cancel my booking because my flight was late?**

Many terms allow the company to treat a late arrival as a no-show, and ECC Malta notes that a company may cancel your booking if your flight is delayed. Giving your flight number at booking and telling the company about the delay as soon as you know improves your position. Check the no-show clause in your terms.

**Do I get compensation on top of a refund?**

There is no fixed EU compensation for car rental like there is for flights. What you can ask for is a refund of what you paid and the reasonable extra costs you had because the car was not there, such as a more expensive replacement car. Keep receipts for everything.

**I booked through a comparison site. Who has to refund me?**

Contact both the rental company and the booking site straight away. Which of them is responsible depends on who your contract is with. Our article on booking through a broker explains how to find out.
