# What can a rental company charge if you return the car late?

> Many rental companies charge an extra full day for a late return, even if you are only an hour late. Some allow a short grace period, often 30 minutes to an hour, but only if the terms say so. If you return after closing time, you may stay responsible for the car until the office opens again, so check the terms, warn the company early and document the return.

You are stuck in traffic on the way to the airport, and the return time on your contract is 10:00. You arrive at 11:10. ==On many contracts, that hour and ten minutes costs you a full extra rental day.== This guide explains what companies may charge, what the consumer centres say and how to keep the cost down.

## The basic rule: a rental day is a rental day

ECC-Net warns that companies may charge a full day for a late return, even if the car is just one hour late. The Austrian ECC repeated this in its June 2026 summer advice: being only a few minutes late often risks an extra rental day.

The charge comes from your contract. Rental terms usually count in periods of 24 hours from the pick-up time. Once you pass the end of the last period, a new one may start.

## Grace periods: check, do not assume

Some companies give a short grace period before an extra day is charged. ECC France notes that some allow 30 minutes to an hour, but advises checking first. If your terms do not mention a grace period, assume there is none.

Look in your terms for words like:

- "grace period" or "tolerance";
- "late return fee";
- "additional day" or "extra day";
- "rental period of 24 hours".

The [terms check](https://scratchfair.com/en/tools/terms-check) highlights these clauses in your own contract.

## What it can cost

| Situation | What companies often charge |
|---|---|
| Inside a stated grace period | Nothing extra |
| Shortly after the grace period | An extra day at the daily rate, sometimes plus a fee |
| Hours late without warning | An extra day, possibly at a higher walk-in rate |
| After closing time | An extra day, and you may stay responsible until opening |

The exact amounts depend on the company and are in your price list. If the extra day is charged at a much higher rate than your booking, ask where that rate is stated.

## After closing time: the risk is bigger than the fee

ECC France explains that if you return after the office closes, you may be responsible for the car until opening hours the next day. That means two things:

1. you may pay for the extra time;
2. anything that happens to the car overnight may be put on your account.

ECC-Net adds that after-hours returns are usually inspected the next day, and that consumers can then be charged with damage at a later stage. So a late return can turn into a damage claim. > [!WARNING]
> If you have to return after closing, film the car in the return area with the time visible, photograph the dashboard and email the company the same evening. Without that, the night is a gap in your evidence.

## 1. Warn the company as soon as you know

Call or email before the return time. Ask whether you can extend the rental and at what price. An extension agreed in advance is usually cheaper than an extra day charged afterwards, and it gives you a written record.

## 2. Keep proof of the delay

A flight delay, a road closure or a breakdown does not automatically cancel a late fee, but it helps if you ask for goodwill. Keep the airline notice, a screenshot of a traffic alert or the breakdown service report.

## 3. Note the exact return time

Photograph the dashboard clock and the car at the return spot. Ask the staff member to write the return time on the form. ECC-Net advises getting a signed acceptance form whenever possible.

## The same problem at pick-up

Lateness also matters at the start. ECC Malta warns that if your flight is delayed, the company may cancel your booking, and advises giving the company your flight number. Many companies hold the car for a set time only. If you know you will be late, contact them before your booking time.

## Common situations and what to do

| Situation | What to do |
|---|---|
| Stuck in traffic, 30 minutes late | Call ahead, ask whether a grace period applies, note the return time |
| Flight changed, you need an extra day | Ask for an extension before the return time and get the price in writing |
| Arriving after closing | Film the car in the return area, photograph the dashboard, email the company that evening |
| Office closed although you were on time | Photograph the closed office and the time, email the company straight away |
| Charged an extra day you think is wrong | Compare the return time on the form with your terms and object in writing |

## If you think the charge is wrong

Compare the charge with your contract, the return time on the form and your photos. If the company charged an extra day while you were inside the grace period, or charged a rate that is not in the price list, object in writing. ## FAQ

**My flight was delayed, so I returned the car late. Do I still pay?**

Usually the rental contract applies regardless of the reason, so a late fee may be allowed by the terms. Tell the company as soon as you know, ask in writing whether you can extend, and keep proof of the delay. Some companies are flexible when warned in time.

**Is a late fee on top of an extra day allowed?**

That depends on your terms. Check whether they mention a late fee, an extra day, or both. If the charge is not in the terms or the price list, you can ask the company to remove it.

**The office was closed when I arrived on time. Who is responsible?**

If you returned on time but the office was closed, note the time with a photo or video and email the company straight away. Ask the company to confirm the return time. That evidence matters if a late fee or a damage claim follows.
